Homeowners' Lawsuit
Certain homeowners have filed a Petition for Derivative Action against Parkway House Condominium, Inc. and have named the Board of Directors (Administrators). The pleadings and documents filed by the homeowners are below. The homeowners' lawsuit was filed in the Chancery Court for Shelby County, Tennessee. Parkway House Condominium, Inc. filed a Motion to Dismiss the Petition for Derivative Action December 30, 2022. On January 11, 2022, additional homeowners filed an Amended Petition for Derivative Action. (This summary is for convenience only. To read the documents filed, the links are provided below.) During the pendency of this litigation, numerous documents have been filed, discovery promulgated and discovery depositions taken. 
 
As of October 12, 2025, the Chancellor is reviewing three motions to dismiss filed by the Parkway House.  All briefs have been filed with the Court by all parties, and we are awaiting a ruling at this time.
